Terms and Conditions Blimp Flight / Charter Booking

DEFINITIONS:

Client and-or Passenger – The individual or entity requesting and-or attending the flight or charter service;

Provider – The company arranging and providing the flight or charter – “Skycruise Aviation Inc.” “Skycruise Tampa”;

Parties – “Client” and “Provider.”

GENERAL:

These terms and conditions apply to blimp flight / charter operations and the amount to be paid for the service is in a separate document titled “Quote”. The Quote is submitted simultaneously herewith and incorporated by reference herein. This Quote is aircraft specific; should the need arise to change aircraft, including to a different type of aircraft, cost may vary accordingly. Client shall be informed of any such change prior to departure and the amount of additional cost, if any.

The quote is based upon aircraft and crew availability and is valid for 7 days, except during recognized “Holiday Periods” when the Quote is valid for 2 days. Upon acceptance of terms and conditions as set forth herein, this document becomes a legal and binding contract between the two parties.

Neither Client nor passengers will obstruct or interfere with the ground or flight crew or tamper with or damage the aircraft in any way, and each will adhere to all applicable laws, rules, regulations and requirements of the United States, its governmental agencies, or any other jurisdiction, including, e.g., Customs & Border Protection and Transportation Safety Administration.

The TSA requires the Parties to follow and The Client agrees to abide by all rules and guidelines set forth in the TSA prohibited items list found at www.tsa.gov.

Client agrees to be and is liable for all abuse and/or all beyond normal repairs or cleaning to the aircraft caused by Client or Client’s passengers. Abuse includes, but is not limited to extra cleaning, repairing, or replacing items damaged or altered by the Client or passengers.

ALL AIRCRAFTS ARE NON-SMOKING. NO EATING OR DRINKING WILL BE ALLOWED ON THE AIRCRAFT.

A passenger name and weight must be completed and or provided in the reservation at the time of booking. The passenger weight is used for flight planning purposes only.

PRICE, PAYMENT AND CANCELLATION:

All flight and charter price quotes are accurate on the date quoted, and are valid for 7 days. Full payment for the flight is due 48 hours before the planned departure date and time. If Client cancels the flight within 48 hours of flight departure time, Client will pay a cancellation fee equal to 50% of the flight / charter quote and if cancelled within 24 hours of flight / charter time 100% of the quote.

Notice of cancellation must be made in writing and transmitted by e-mail to info@skycruisetampa.com . A no show for a flight / charter will be charged the full amount of the booked flight / charter.

If a flight is cancelled by the Provider (Skycruise Aviation Inc.), the provider will offer an alternative. In case of impossibility, the client will receive back a refund for the amount paid. The provider will not cover any travel or hotel costs.

MOBILITY:

All clients / passengers are required to inform the provider at the time of reservation or booking whether the client or any of its passengers has any mobility disabilities. This information will help the provider plan and provide the safest service and flight / charter possible for the client.

DOCUMENTATION:

All clients / passengers must present “Photo ID” to Provider representative at check-in and prior to boarding for the flight / charter’s departure. Additionally, each passenger is solely responsible for obtaining any official or required travel document (e.g., passport; visas).

ATTENTION PASSENGERS: You may be subject to fines and/or arrest by governmental authorities if you do not have required or proper documentation, for which the Company assumes no responsibility or liability.

ITENERARY CHANGES and TRANSMITTAL OF CHANGES:

Itinerary changes are permitted upon request. A request for an itinerary changes must be completed online by logging into your account via skycruisetampa.com or by contacting our customer service at +1 407 861 1208 or via email at info@skycruisetampa.com no later than 48 hours before the flight.

TRANSFER OF BOOKING OR RESERVATION:

Client or passenger Transfers of bookings and reservations are not permitted.

LIMITATION ON LIABILITY:

PROVIDER MAKES NO EXPRESS OR IMPLIED WARRANTIES OF ANY KIND. Provider shall not be liable to Client or passengers for any injury, loss, expense or damages or for any consequential, indirect, special or punitive damages, even if it has been put on notice of the possibility of such damages. Provider shall not be liable for any accident, delay, flight schedule, change, cancellation, sickness, weather, strike, war, quarantine, or act of God or any similar cause or for any travel irregularity caused by a defect of any vehicle or conveyance in connection with the Client or passengers travel, or for the negligence of any company or person engaged in conveying the passenger or carrying out the arrangements for Client or passengers’ trip. Provider’s liability shall in all cases be limited solely to the amount paid for the flight. All passengers are required to complete and sign in full their own Participation Agreement and submit same prior to flight. The terms of the Participation Agreement are incorporated by reference herein.

GIFT CARDS AND VOUCHERS:

Gift Cards and or Vouchers or a fraction of any Gift Card or voucher cannot be reimbursed.

TRAVEL INSURANCE:

To reduce your personal costs in case of an unexpected cancellation on the client or passenger’s side, the client may contact its own Insurance Broker to check for the possibility of existing travel insurance. The Provider (Skycruise Aviation Inc.) does not offer such service.

RESTRICTIONS:

Passengers with a weight over 300 lbs (pounds) may not be permitted to board the blimp due to material load limitations without prior authorization from the Provider.

Children under the age of two and potential clients or passengers in wheelchairs are not permitted on board the aircraft without prior organization and coordination with the provider. Children under the age of 12 must be accompanied by an adult.

Client and passengers must be able to walk a distance of approximately 100 feet over grass or gravel and are also required to climb up and down stairs without assistance during the boarding and disembarking.

Walking aids cannot be brought on board the aircraft.

If a client or passenger does not meet the physical or weight regulations, the provider may refuse the passenger on board due to our safety regulations. In such circumstances the booking will be reimbursed. Travelling companions booked on the same flight cannot cancel the booking or flight.

No Animals are allowed onboard the aircraft.

CHECK-IN:

Due to legal requirements, the check-in deadline is 1 hour before the scheduled departure time for the flight. The Provider (Skycruise Aviation Inc) reserves the right to cancel the client’s reservation if the client or its passengers do not comply with the check-in deadline. The flight expires without substitution and without refund if the client does not show up for the check-in deadline.

FLIGHT TICKETS:

On the day of the flight, the client will receive a flight ticket after presenting the booking confirmation/invoice which proves that full payment was made and an official identification document (ID card, passport, or driving license) at the check-in desk. Tickets will not be issued before full payment of the flight price has been made.

ELECTRONIC DEVICES:

Electronic devices that can send and receive signals may only be used after the permission of the cabin crew has been granted. Otherwise, it is prohibited at all times when on board the aircraft. Please leave such devices switched off or put them into flight mode. The use of standard consumer cameras is allowed on board the aircraft. Please follow the instructions of the ground and flight crew at all times.

CLOTHING AND SHOES:

During the boarding or disembarking process, clients and passengers may have to walk on unpaved surfaces such as grass or gravel. Therefore, for the safety of the client and passengers appropriate footwear is required. No high heels, flip flops or open toe shoes are allowed.

PARTIAL COMPLETION OF FLIGHTS:

Provider is not liable to Client or passengers for any delay, costs, expenses or fees relating to securing any alternative travel arrangements or replacement transportation due to an aircraft mechanical problem or weather-related delay or cancelation. In such instances, flight charges apply only to the completed portions of the flight. If a flight does not reach its destination due to weather, calamity or act of God, charges will apply to any alternative destination reached.

If a flight is aborted, the actual flight time will be calculated at a pro-rated per minute rate. Any difference can be used for a new booking or be reimbursed. Should a flight be aborted less than 15 minutes after boarding, the client will be offered a re-booking into an alternative flight for the full length of the original reservation.

IF BOOKING ONLINE: BY CLICKING THE ACCEPT TERMS AND CONDITIONS BUTTON BEFORE BOOKING A RESERVATION THE CLIENT ACKNOWLEDGES RECEIPT AND UNDERSTANDING OF THE PRECEDING TERMS AND CONDITIONS AND THIS DOCUMENT BECOMES A BINDING LEGAL DOCUMENT.
